General Terms and Conditions (GTC) for yamshare.de
1. scope of application
These GTC apply to the use of the yamshare.de platform, which brings together amateur chefs and customers. The platform only offers an intermediary function.
2. platform function and disclaimer
yamshare.de enables amateur chefs to offer home-made dishes and customers to buy them. The platform is neither a contracting party nor does it play an active role in the conclusion or fulfillment of contracts between users.
We assume no liability for the food offered, its quality, composition or compatibility. We also accept no liability for damage caused by the use of the platform or the consumption of the food offered.
3. no guarantee for sales success
yamshare.de cannot guarantee that the food offered by amateur chefs will actually be purchased. There is no claim to a certain turnover or a certain number of sales.
4. personal responsibility of the hobby chefs
Every amateur chef is responsible for advertising and marketing the food he or she offers. The platform is not responsible for the distribution or advertising of the offers on social networks or other channels.
5. evaluation system
Customers have the opportunity to rate the hobby chefs and their dishes. This makes the quality and reliability of the providers visible to other users.
6. disputes
Disputes between hobby chefs and customers must always be resolved independently. In exceptional cases, users can contact yamshare.de support, but the platform assumes no obligation to mediate or resolve disputes.
7. description of the dishes
Every amateur chef is obliged to provide a precise description of the dishes prepared and a complete list of the ingredients used. Incomplete or misleading information is not permitted.
8. freshness and quality of the ingredients used
All users of the platform undertake to work exclusively with fresh, non-spoiled and flawless food. The sale or processing of expired, spoiled or unhealthy goods is strictly prohibited. Violations may lead to permanent exclusion from the platform.
9. regional search and geolocation
A geolocation service from Google is used for the regional search for offers. By using the platform, users agree to their location data being used to improve the search function. Further information on data protection can be found in the privacy policy.
10. payment modalities
Payment for the food is made directly between hobby chefs and customers. Customers have the option of transferring the food directly to the respective provider via PayPal or paying in cash on collection.
In addition, the service fee can be paid by direct debit authorization. Hobby chefs will receive a corresponding form by e-mail, which must be signed and returned. Alternatively, payment by invoice is also possible. Invoices are issued every 7 days.
11. pricing and service fee
The prices are set exclusively by the respective amateur chefs. The platform has no influence on the prices or the content of the offers.
A service fee (commission) is charged for each successful sale of a portion. This service fee is invoiced to the hobby chefs every 7 days by yamshare.de and must be transferred independently if no direct debit authorization is available.
12. use of the platform
Each user is responsible for complying with legal regulations, in particular with regard to food and hygiene regulations. The platform does not check the offers for accuracy or completeness.
13. final provisions
Users will be notified of any changes to these GTC. German law applies exclusively to disputes.

4. use of geolocation
We use a geolocation service from Google for regional searches. Location data is processed in order to show you suitable offers in your area. Geolocation is only used with your express consent. Further information can be found in Google’s privacy policy.

Our website uses cookies to make it easier to use and to provide functions.

6. evaluation system
As part of the rating system, we process your ratings, names and any other data you enter. This information is visible to other users and is used for quality assurance purposes. The data is stored on the basis of your legitimate interest (Art. 6 para. 1 lit. f GDPR).
7. payment processing
The following methods are available for payment:
- PayPal: Payment data is transmitted to PayPal. You can find PayPal’s privacy policy at https://www.paypal.com/de/webapps/mpp/ua/privacy-full.
- Cash payment on collection: No additional data will be transmitted.
- Direct debit authorization by e-mail: For this we need your signed consent, which will be sent by e-mail.
- Payment on account: Invoices are issued every 7 days.
The processing of payment data is carried out to fulfill the contract (Art. 6 para. 1 lit. b GDPR).
8. disclosure of data
Your personal data will only be passed on to third parties if this is necessary to fulfill the contract (e.g. payment service providers) or if we are legally obliged to do so.
9. storage and deletion
Personal data is only stored for as long as is necessary to fulfill the purposes or for as long as statutory retention periods exist. Once the purpose no longer applies, the data is deleted or anonymized.
10. safety
We use technical and organizational security measures to protect your data from manipulation, loss or unauthorized access. Our website uses SSL/TLS encryption, recognizable by “https://” in the address bar.
